Corp. reserves the right to assume the exclusive defense and control of any matter
subject to indemnification by you.

Agreement, together with any Additional Terms, Rules, our Privacy Policy and
any other regulations, procedures and policies which CaféMétaphysics
refers to and which are hereby incorporated by reference, contains the entire
understanding and agreement between you and CaféMétaphysics. It
supersedes any and all prior or inconsistent understandings relating to our
Website and your use of the Site.
This
Agreement and your use of CaféMétaphysics site is governed by,
construed and enforced in accordance with the internal substantive laws of the
State of Florida, (nothwithtanding the State’s conflict of laws
provision). Each party to this Agreement submits to the exclusive
jurisdiction of the state and federal courts sitting in the county of Sarasota
or any other county in the State of Florida, as chosen by One Tv, Corp. You
agree not to object to such jurisdiction or venue on the grounds of lack of
personal jurisdiction, forum non-conveniens or otherwise. To the extent it may
be applicable, you agree to opt out from and expressly exclude any
applicability of the Uniform Computer Information Transactions Act.
Each
party to this Agreement further agrees that:
Any
claim brought to enforce this Agreement must be commenced within one (1) year
of the cause of action accruing
No
recovery may be sought or received for damages other than out-of-pocket
expenses, except that the prevailing party will be entitled to costs and
attorneys' fees
Any claim
must be brought individually and not consolidated as part of a group or class
action complaint.
In the
event that any of the provisions of this Agreement are held by a court or other
tribunal of competent jurisdiction to be unenforceable, such provisions shall
be limited or eliminated to the minimum extent necessary so that this Agreement
shall otherwise remain in full force and effect.
IN ANY
ACTION OR PROCEEDING COMMENCED TO ENFORCE ANY RIGHT OR OBLIGATION OF THE
PARTIES UNDER THIS AGREEMENT, YOUR USE OF THE SITE OR WITH RESPECT TO THE
SUBJECT MATTER HEREOF, YOU HEREBY WAIVE ANY RIGHT YOU MAY NOW HAVE OR HEREAFTER
POSSESS TO A TRIAL BY JURY.
This Agreement constitutes the entire agreement between One TV, Corp., its DBA CaféMétaphysics,
and You, the User. Any and all written or oral prior agreements between the
parties with respect to the subject matter of this Agreement are definitely
cancelled. One Tv, Corp. may modify the terms of this Agreement by posting
notice of such modification on the page of this website entitled "Legal
Notices" (or similar title) before the modification takes effect. The
notice will be posted on this link 7 (seven) calendar days prior to going into
full effect.
These
Terms of Conditions and any rights and licenses granted herein, may not be
transferred or assigned by you, but may be assigned by CaféMétaphysics
without restriction.

case of a mistake in birth or name information by you or by CaféMétaphysics:

be added for corrections. If the error is on our part we will correct it at no

“Services” are rendered in good faith. To protect your privacy,

Refunds
for ‘Products’ acquired through our website will need to be handled
directly with the suppliers as stated herein.
Chargebacks
All of Café Metaphysics sales for any of our
‘Services’ are final and non-refundable. By ordering any of our
metaphysical ‘Services’ you irrevocably agree to forfeit any
request for reimbursement.
Dispute
Resolution
Notwithstanding the preceding paragraph, we invite
you to contact us prior to putting a stop payment on your account. Send your
request to admin@CaféMétaphysics.com explaining the reasons of the dispute as we may
decide as a courtesy gesture to either void the sale or issue a refund.
We do
track, confirm and verify the entire delivery, receipt, viewing online,
downloading and/or saving to your computer process and are entirely capable of
refuting charge backs. Charge backs do not eliminate buyer's payment
responsibility for work done. Steps will be taken to collect the amount
independently regardless of order size. If the amount remains uncollected the
case will be reported to the credit bureaus. Stop payments initiated by clients will be charged a $100.00 fee in
addition to all the costs incurred to retrieve the funds.
CaféMétaphysics
has no responsibility or liability whatsoever for any goods and services
(hereinafter “Products”) offered for sale on its site from Third
Parties or for goods or services you may obtain from or through other websites
or web pages, even if you were directed or linked to such a site or page
through CaféMétaphysics. We are also not accountable for helping
you in correcting any problem you may experience with acquired Products.
All goods
and services offered for sale on the Site (herein "Products") are
guaranteed by the manufacturer, licensor or distributor against defects in
material and workmanship for a specific duration from the date of the invoice.
To correct, repair or replace the defective Product or, if applicable, in
obtaining a refund, please contact the Products supplier directly.

Café Metaphysics is an esoteric metaphysical website
where information displayed and discussions conducted are geared to serious
esoteric topics.
Given the nature and substance of its content, CaféMétaphysics
DOES NOT recommend anyone below 21 to navigate on its website. Parents are
strongly urged to explain the nature of the site content to their children and
to take the necessary precautionary measures for them not to access the site,
particularly if any of our esoteric topics is in contradiction
with your beliefs.
Furthermore as a parent, you are invited to consider the
following guidelines to help your children make safe decisions about using
online communities, some of which may be in contradiction with your own
beliefs.
Talk to your children about why they use CaféMétaphysics,
the nature of metaphysical topics, the fact they may not understand the gist of

CaféMétaphysics is a public space. Teens
sometimes think that adults cannot see what they post. Members should not post
anything they would not want the world to know (e.g., phone number(s), address,
IM screen name, or specific whereabouts). They also should not post
anything that could embarrass them later or expose them to danger. We
strongly recommend and urge you, the parent or legal guardian, to advise and

for a stranger to find them. Tell them that they should not post photos, video
clips or any type of information they would not want strangers and/or adults to

world, but members should be cautious when communicating with people they do

Harassment, hate speech and inappropriate content should be
reported. If your kid(s) encounter inappropriate behavior, let them know
that they can let you know, or that they should report it to CaféMétaphysics

Two main reasons for that:

Certain functions are available to members only. We need to
identify our members to improve our service identifying your favorite types of
music so we can make CaféMétaphysics user-friendlier for you.
2.
We are required by law to identify anyone who will be posting
photos, videos or anything else in their blogs. This is among other things to
protect copyright owners. Please read our Privacy Policy section for more on
that matter.
We cannot accept registrations from children under the age of 13
because of the Children's Online Privacy Protection Act ("COPPA")
which was enacted to prevent web sites from giving or receiving information
from children without their parents' or legal guardians’ consent.
Also, some esoteric topics posted on CaféMétaphysics
are not geared to children.
